These booking conditions, together with the other information contained on this website – www.528ibiza.com, form the basis of your contract with Forked Up SL. for tickets/VIP. Please read them carefully as they set out our respective rights and obligations. INTRODUCTION In these conditions a reference to: “You”, “Your” means the person making the booking and other attendees related to your ticket/bed purchase “Lead Name” means the person identified as making the ticket/bed purchase during the booking process “Hotel” means, as the context requires, the hotel in which a particular Event Venue is situated; “Venue” means the location of the event; which would be inside 528 Ibiza “We”, “Us”, “Our” mean Forked Up SL, a company registered in Spain with registration number [Insert Registration Number] and registered address at [Insert Registered Address]; Forked Up SL is covered by an INDIVIDUAL DEPOSIT sum to the limit of 60,000 euros, to guarantee the economic responsibilities in case the obligations are not met before the consumers and end-users – Art 10 of Decree 13/2011, on 25 February – , which establishes the general provisions necessary to have the freedom of establishment and provision of touristic services, the regulation of the declaration responsible and simplification of the administrative procedures related to tourism. Please read the Terms and Conditions carefully. They apply to all bookings made for Forked Up SL and to all members of your event booking. EVENT DATES, TIMINGS & PROGRAMME All Forked Up SL events, as well as other branded events by external promoters, will take place in 528 Ibiza on selected dates in April, May, June, July, August, September & October. All event programmes, days, and dates are subject to change. Any specific artists or event programmes presented at the time of booking are not guaranteed to be the eventual artist or event programme. You should always check that your booked Event is going ahead at the scheduled date, time, and venue. Headline artist set times for events are not announced in advance and are subject to change. Our opening times do vary depending on the event, so please always check your ticket. There will always be a last entry restriction and this does vary per event, so please check the individual terms and conditions of your chosen event. Your Event Booking will remain confirmed regardless of the weather on the event day unless otherwise communicated by the official communication channels of Forked Up SL. ENTRANCE POLICY & CONDUCT No one under the age of 18 will be permitted to enter the Venue and some events may stipulate a different minimum age, so please ensure you check before booking. Pikes Presents is a brand born from the values of our much loved community. Guests who attend have a true passion for great music, a respect for one another, a desire to experience the kind of Ibiza that doesn’t exist elsewhere and a want to live in the moment. These Pikes Presents shows at 528 Ibiza follow the same codes as our in house events. We operate a 27+ policy – exceptions will be made and guests under 27 (but over the age of 21) will be able to attend, if the majority of your group attending are over 27. We also kindly ask you to respect the other codes and the values behind them. Even if you have a ticket, our door team reserve the right to refuse entry to anyone who doesn’t follow our simple rules — we want to maintain the magic that exists in our Pikes community. Any customer who is under-age at the time of the event will not be allowed into the Venue and no refund will be issued. Every person entering the Venue must have a valid form of photographic identification, such as a passport or driver’s license. The management reserves the right to deny admission, to refuse any entry and/or eject any person from the Venue who appears to be intoxicated, under the influence of drugs, or behaving in a dangerous, inappropriate, or abusive manner. Please note that no refunds will be given should you be refused entry due to being underage based on the individual event age restriction Any form of verbal or physical abuse towards employees of 528 Ibiza or fellow customers will not be tolerated and may result in prosecution. For safety reasons, we reserve the right to search clothing, bags, and all other items upon entry and exit, and we may confiscate any items that may cause danger or disruption to others. Food and drink items purchased outside the Venue are not allowed to be taken inside the Venue. Entry into the Venue is at the manager’s discretion. There will often also be rules restricting or preventing the admission of latecomers depending on the time of arrival and the time the event finishes. Please note the last entry times of the venue and conditions of Your purchased Event option. SLR cameras, unauthorized video cameras or equipment for the professional recording or transmitting (by digital or other means) of any audio, visual or audio-visual material within the Venue are strictly forbidden and are not permitted at any time. Any such material may be confiscated and/or destroyed by the Promoter. Any recording made of the Event in breach of the Conditions shall belong to the Promoter and You agree to assign any and all rights in any such recordings to the Promoter. If you wish to record inside the venue, please contact our marketing team in advance. Selfie sticks are also not permitted. You shall not bring into the Venue or display or distribute at the Event any sponsorship, promotional or marketing materials without the Venue's prior written consent. By entering the Event, You give Your express consent to being photographed/filmed or sound recorded as part of the audience, and to Your name, voice and/or likeness being included within any film, photograph, audio or audiovisual recording of the Event to be exploited in any and all media for any purpose at any time throughout the world with no reimbursement or copyright. This may include filming by the police or security staff for the security of attendees at the Event or the prevention of crime. Animals are not allowed in the venue. We have a strict no re-entry policy. Disabled facilities are available. Please contact Us in advance of the Event at [email protected] if You have any specific access requirements, otherwise, it may not be possible to meet Your needs. If You or any member of your party has any other particular requirements please raise these when booking and we will endeavor to address your query (Contact us: [email protected]). There can be no guarantee that requirements can be met if notified at the event. TICKET TERMS & CONDITIONS Full payment (including any booking/processing fees) will be required for your event tickets at the time of booking. Your event Ticket will be dispatched to you electronically and to the email address provided at the point of booking. Always check Your event Ticket email upon receipt and advise us promptly of any errors. Mistakes when ordering cannot always be corrected, and any corrections are discretionary. The event ticket is only valid for the specific date purchased and must be shown on entry into the Venue alongside photographic ID that matches the named ‘Lead Guest’ marked on the ticket email. It is Your responsibility to check and understand any additional entry conditions of Your event Ticket. Failure to comply with these conditions will result in your entry becoming void. If you purchase an event ticket marked “Early Entry” you must enter the venue before the time displayed on Your Ticket / Booking Confirmation. If you arrive at the venue after this stated time you may be required to pay an additional fee to enter. If you have purchased a ticket marked ‘island resident’, You will be required to present ID on the door as proof of resident status (for all members of your party). If you and/or other members of your party are unable to do this, you will be charged €20 per person for those who do not present the appropriate ID at the door. Entrance paid at the door on the day may be higher than the advance price. Should you need to make any amendments to your event/VIP ticket at any time prior to the event itself, please email us at [email protected] and we will review your request in line with the terms and conditions. Should you wish to cancel your event/VIP Ticket completely at any time this will result in a loss of 100% of the total booking amount (including any booking/processing/cover charge fees). Event/VIP Tickets are sold subject to the management’s right to alter or vary the events calendar due to events or circumstances beyond its control without being obliged to refund money or exchange tickets. The purchaser represents and warrants that the event/VIP ticket is purchased for personal use only, and may not be resold or offered for resale by anyone. Resale or attempted resale of an event/VIP ticket is grounds for cancellation of that ticket, and the holder may be refused entry to or ejected from the Venue without refund or other compensation. If an event is rescheduled, event/VIP ticket holders will be offered tickets to the rescheduled event. Customers who have purchased General Admission event/VIP Tickets must arrive before 8pm. We cannot guarantee General Admission Entry after this time. Event/VIP Tickets cannot be used as part of any marketing, media, sales promotion, or competition, whether commercial or non-commercial, or be combined with any hospitality, travel, or accommodation service to create a Ticket package without the prior written consent of the venue. VIP RESERVATION (SOFA/TABLES) All VIP reservations at the Venue are based on a cover charge plus a minimum spend agreement unless clearly stated. The cover charge is the hire cost of the table/sofa space, which includes entry to the venue and is not included in the minimum spend credit You have to spend The minimum spend is the minimum amount your party commits to spend that day on food and drink from the venue. At the time of booking a 25% (deposit) of the minimum spend plus 100% of the cover charge (plus any booking/processing fees) is required. These amounts may vary per event or per event option. If choosing to pay a deposit the remaining 75% balance of the minimum spend must be paid on arrival at the venue. Should you wish to cancel your VIP Reservation prior to the event will result in a loss of deposit amount (including any cover charge & fees paid). Your minimum spend can only be spent against Table Service orders only from the VIP menu and cannot be used at any Venue Bar unless stated. Payment for Food or Drinks purchased from the Venue bar would need to be settled separately. If you do not reach your minimum spend during the hours of the event, you will not be refunded the difference, and the remaining amount cannot be transferred to another booking or event. If you spend over your minimum spend amount the balance difference will need to be settled before you leave the Venue. Sofa / Table spaces are allocated based on the category/area you have booked and the size of your group. The Venue has the right, at its discretion, to move/upgrade customers to a different location and piece of furniture within the Venue at any point. In these instances, and given the switch will always be to a similar or better piece of furniture, You will not be entitled to any form of compensation. Any such change will be discussed with You at the venue. No extra guests will be allowed to join the reservation beyond the stated capacity of the space(s) you have purchased. This includes guests with Tickets. HOTEL GUESTS Guests staying at Ibiza Rocks Hotel & Pikes may Ibiza have General Admission Tickets to all events occurring in the Venue during the dates of their stay included in the price of their room. Any guests of Ibiza Rocks Hotel & Pikes will not be entitled to any form of refund should an event be cancelled. PRICING & PURCHASES All prices are displayed in the local currency to the event location (in this instance euros/€). Should prices be displayed in any other currency they are indicative only. Any price presented when selecting any currency other than the local currency is based on an indicative exchange rate. Upon checkout, depending on your payment method and card supplier, you may be given the option to pay in another currency. If you choose to pay in a different currency the final price charged to your account will depend on both the rate of any commissions applied by the card payment provider together with the effect of any differential in the exchange rate applied by your own bank/card provider compared to our indicative rates (at the time of your bank processing the transaction). All purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in full. In rare circumstances, if your payment is recalled by the associated bank or payment provider, we reserve the right to cancel and refund any order for which an order confirmation has been sent. We accept no responsibility or liability for such cancellations, as these are outside our control. To prevent fraud and protect us, we reserve the right to carry out checks and/or request that additional information be provided in order to verify purchases. We reserve the right to cancel any orders that we reasonably suspect to have been made fraudulently, without any notice to you, and any and all Items obtained as part of such orders will be void. Whilst we try to ensure that all advertised prices are accurate, errors may occur. If we discover an error in the price of any Item you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price (in which case we will credit or debit you as applicable) or canceling your order (in which case you will receive a full refund). If we are unable to contact you to confirm your order at the correct price, you agree that we may treat the order as canceled and issue you with a full refund, without any further liability. Sale Prices may increase or decrease at any time, based on demand. This is similar to how airline tickets and hotel rooms are sold and is commonly referred to as “Dynamic Pricing”. You will not be entitled to a refund or credit if the Sale Price you paid for a Ticket was at any time before you purchased your Ticket less than the Sale Price you paid; or the Sale Price of any other Tickets to the relevant event (whether in the same price category or otherwise) is/are subsequently reduced after you purchase your Ticket. Payments may be made by any major credit or debit card. We use sophisticated encryption technology to ensure your credit card details are secure. We do not accept laser cards or cash cards. Your contract for purchase starts once we have confirmed your booking (which is immediate from your payment being processed upon check-out) and ends immediately after completion of the event for which you have purchased Item(s). All online orders are subject to a Processing Fee. This is inclusive of a €2 donation to the Venue partner charities. Your payment will be fully invoiced by Forked Up SL, a company registered in Spain with registration number [Insert Registration Number] and registered address at [Insert Registered Address]. RESCHEDULED & CANCELED EVENTS If an Event is rescheduled, the Venue will usually give you the option of either retaining or exchanging your ticket for a new date, or alternatively claiming a refund. If an Event is fully cancelled by the venue, you will be offered a full refund of the monies paid to date (and you will be contacted via email). Any rescheduling or cancellation will be communicated to you by means of an email to the email address provided at the time of booking. To claim any refund (should one be offered) you must take action by following the instructions provided within communications from the Venue/Promoter. If we do not hear back from you within 30 days of the Event being canceled & communicated to You we will automatically cancel your booking with no refund. Any refund agreed will be; Paid to the same payment method used to pay for the ticket (or any payment method mutually agreed between yourself & the venue) & paid within 7 – 60 days of the date a refund was agreed between yourself and the Venue. No refunds will be offered under any circumstances if you fail to comply with all terms and conditions applicable to the ticket, the venue and/or the event. Any Booking and/or transaction/processing fees are non-refundable in any circumstances. DRESS CODE The Venue reserves the right to refuse admission for unsuitable attire, which includes body paint, fancy dress, novelty shoes, and hen/stag accessories (including veils, sashes, and matching t-shirts). Props, including inflatables, are strictly prohibited. All guests must wear footwear to arrive and are also required to depart the venue respectfully clothed (tops and shorts/skirt). PERSONAL BELONGINGS We do not store any luggage or large bags at the venue, so they will not be permitted inside. Please note that all customers are responsible for their own belongings when attending an event. The Venue does not accept any responsibility for any personal property. Any personal possessions or other items which are found at the Event shall be retained by the Venue for a period of 30 days following their discovery. During this period You may collect any item which belongs to You from a location specified by the Venue upon reasonable proof of identification and ownership. If, upon the expiry of 30 days from the date of its discovery, any item has not been collected by You, the Venue reserves the right to dispose of any such items as it sees fit without any further liability to You (notwithstanding anything else in the Conditions). Where possible, any uncollected items will be donated to charity. SAFETY & WELL-BEING In case of injury or accident, please make yourself known to our team. Please act and drink responsibly inside the venue, and make sure you stay hydrated, especially during peak season when the sun is strongest. Please remember the following when receiving bottles of champagne and opening them: Do not shake or point the bottle in the direction of yourself or anyone else. When the bottle is empty, please dispose of the glass bottle safely or give it to a member of the team. If coming from abroad It is a strict requirement of Forked Up SL for you to have adequate and comprehensive Holiday/Travel Insurance to attend an event at the Venue. COMPLAINTS If you have a complaint whilst you are attending an event, you must inform the Venue Management immediately in order to give them the chance to resolve the problem. A report form should be completed with a member of the Venue team whilst you are at the event. Any right to compensation may be lost if you fail to do this. If you are not offered a report form please ask to speak with a member of the Management team at the Venue. If you made a booking through an agent or third parties please direct any post event complaints to the booking agent in the first instance, they will make contact with the Venue Provider on your behalf to get a resolution. OTHER Maintenance, changes, and improvements take place all season round. No compensation will be offered if a facility is unavailable during your event, but the Venue will endeavor to provide a suitable alternative. We cannot be held responsible for the failure of public services (e.g. water, gas, electricity etc.) or for any disturbance that is beyond our control. In all cases including personal injury or death, our liability to you for the total of all claims arising out of your holiday with us, is limited to the cost of the booking. “Force Majeure” means any cause beyond the Venue / Promoter’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defense requirements, acts or regulations of national or local governments. The Venue will not be liable to You for failure to perform any obligation under the Conditions to the extent that the failure is caused by Force Majeure. We cannot be liable in any way for the acts or omissions of others. The purchase by you of tickets and/or VIP tables or sofas and these terms and conditions (and any contractual or non-contractual matters arising in relation to these terms and conditions) are governed by Spanish law and any disputes arising out of any transaction between you and Forked Up SL are subject to the exclusive jurisdiction of the Spanish Courts. END.
